Terms of Service

Welcome to KIKII.

These Terms of Service apply when you access or use KIKII, including our website, mobile app, venue pages, event pages, DJ and artist profiles, promoter pages, recommendations, invoice tools, live updates, chat features, presales, deals, directories, communications and any related services.

In these Terms, KIKII, we, us and our refer to the KIKII platform. You and your refer to the person accessing or using KIKII.

By using KIKII, you agree to these Terms. If you do not agree, you must not use KIKII.

Your use of KIKII is also governed by our Privacy Policy and Cookie Policy.

1. What KIKII does

KIKII is a nightlife discovery platform designed to help people find venues, events, DJs, artists, promoters and experiences worth leaving the house for.

KIKII may include:

  • venue listings and venue profiles
  • event listings and event pages
  • DJ, artist and promoter profiles
  • nightlife search and discovery tools
  • personalised recommendations based on vibes, genres, location and preferences
  • public profile pages for DJs, artists, promoters and venues
  • event creation and listing tools
  • venue, crowd, vibe and music genre tags
  • links to ticketing platforms
  • presales, waitlists or RSVP features
  • deals, discounts or venue offers
  • live updates about venues or events
  • in-app chat or community features
  • invoice and billing tools for DJs, artists or service providers
  • marketing, support and communication tools
  • embedded media, including music players, maps, videos and social links

KIKII may change, improve, pause or remove features from time to time. We do not guarantee that any particular feature will always be available.

2. Licence to use KIKII

We grant you a limited, revocable, non-exclusive, non-transferable licence to access and use KIKII for personal or permitted business purposes, subject to these Terms.

You must not copy, reverse engineer, scrape, reproduce, resell, interfere with or misuse KIKII unless we have given you written permission.

3. Eligibility

You must be at least 16 years old to create an account.

Some parts of KIKII relate to nightlife, licensed venues, alcohol-serving venues, clubs, bars, late-night events and adult environments. You are responsible for ensuring that you are old enough to attend any venue or event you discover through KIKII.

Some events or venues may require you to be 18 years or older, hold valid ID, meet dress code requirements or comply with venue entry conditions.

KIKII does not guarantee that you will be permitted entry to any venue or event.

4. Accounts

You may need an account to access certain features, such as:

  • saving favourites
  • creating a DJ, artist or promoter profile
  • submitting or managing events
  • managing venue or event listings
  • using invoice tools
  • submitting live updates
  • using chat or community features
  • accessing presales, waitlists or deals
  • receiving personalised recommendations

You are responsible for:

  • keeping your login details secure
  • all activity under your account
  • ensuring the information you provide is accurate
  • updating your details when they change
  • not allowing someone else to use your account without permission

We may suspend, restrict or close your account if we believe you have breached these Terms, created risk for KIKII or other users, provided false information, misused the platform or acted unlawfully.

5. Profile types

KIKII may allow different profile types, including:

  • general users
  • DJs
  • artists
  • promoters
  • venues
  • editors
  • admins

Some profiles are public. For example, DJ, artist, promoter, venue and event pages may be visible to other users and search engines.

You are responsible for the information you publish on public profiles. Do not upload private, confidential, misleading, unauthorised or unlawful content.

6. Public profiles, artist pages and promoter pages

KIKII may allow DJs, artists and promoters to create public pages that showcase their work, identity, events, links, press kits, media and profiles.

Public pages may include:

  • name or stage name
  • profile photo or logo
  • banner images
  • biography
  • music genres
  • vibe tags
  • social media links
  • website links
  • SoundCloud, Spotify, YouTube or other media embeds
  • press kit material
  • tech rider material
  • gallery photos
  • upcoming or past events

You must only upload content that you own, have permission to use or are legally allowed to publish.

KIKII may remove, edit, hide or restrict public profile content if it breaches these Terms, infringes rights, misleads users, causes harm or creates legal risk.

7. Venue and event listings

KIKII may display information about venues and events, including:

  • venue names
  • addresses
  • opening hours
  • event dates and times
  • ticket links
  • line-ups
  • descriptions
  • images
  • crowd types
  • music genres
  • vibes and experience tags
  • dress codes
  • social links
  • website links
  • location information
  • accessibility or entry details where available
  • queue, busyness or live status information where available

We aim to make KIKII useful and accurate, but venue and event information can change quickly.

You acknowledge that:

  • events may be cancelled, postponed, moved or changed
  • venues may change opening hours, dress codes or entry rules
  • line-ups, set times and ticket prices may change
  • live venue information may be delayed, incomplete or inaccurate
  • user-submitted information may reflect personal opinions or temporary observations

You should always check important details directly with the venue, promoter, organiser or ticketing provider before making plans.

8. Recommendations and vibes

KIKII may suggest venues, events, DJs, artists, promoters or experiences based on your activity, location, selected vibes, genres, saved interests, followed profiles, browsing behaviour or other signals.

Recommendations are provided for convenience only. They are not guarantees.

KIKII does not guarantee that:

  • an event will suit your taste
  • a venue will match your expectations
  • a recommendation will be accurate or current
  • an event will go ahead
  • you will be granted entry
  • a venue will honour a deal, offer or promotion

You are responsible for deciding whether a venue, event or experience is appropriate for you.

9. Ticketing and external platforms

KIKII may display ticket links, RSVP links, presale links or other external links for events.

Unless clearly stated otherwise, KIKII is not the ticket seller, ticketing platform, merchant of record, event organiser or payment processor for third-party ticket purchases.

Ticket purchases may occur through external platforms such as ticketing providers, venue websites, promoter websites or event platforms.

KIKII is not responsible for:

  • ticket availability
  • ticket pricing
  • refunds
  • booking fees
  • event cancellation policies
  • ticket delivery
  • ticket validity
  • entry disputes
  • third-party platform errors
  • terms imposed by ticketing providers, venues or promoters

Any ticket purchase is between you and the relevant third-party provider.

10. Pricing, fees and estimates

KIKII may display prices, ticket ranges, entry fees, cover charges, promotional pricing or estimates.

Pricing information may be based on publicly available information, third-party data, user submissions, promoter information, venue information or manual entry.

We do not guarantee that pricing information on KIKII is accurate, current or complete.

Prices may be wrong because of:

  • outdated information
  • event organiser changes
  • ticket tier changes
  • sold-out allocations
  • currency or fee changes
  • data processing errors
  • manual entry errors
  • expired promotions
  • changes made by third parties

You must verify pricing, availability and terms directly with the official ticketing provider, venue, promoter or organiser before buying anything.

11. Presales, waitlists and registrations

KIKII may offer internal or external presales, waitlists, RSVP features or registration tools.

An internal presale or waitlist may require information such as your name, email address, phone number or event preferences.

An external presale may redirect you to a third-party platform. KIKII does not control third-party presales or ticketing systems.

Participation in a presale, waitlist or registration does not guarantee:

  • access to tickets
  • event entry
  • a particular price
  • availability
  • priority access
  • acceptance by the venue or organiser

Each presale, waitlist or registration may have its own conditions. You are responsible for reviewing those conditions before participating.

Where clearly disclosed, we may share relevant registration details with venues, promoters, organisers or event partners for that event.

12. Deals, discounts and offers

KIKII may display deals, offers, discounts, perks or promotions from venues, promoters, events or partners.

These may include:

  • general offers available to users
  • venue discounts
  • event offers
  • early access
  • complimentary items
  • reduced entry
  • member-only or subscriber-only perks, if offered

Unless clearly stated otherwise, KIKII only displays or facilitates these offers. The participating venue, promoter, event organiser or partner is responsible for honouring the offer.

Deals and offers may be subject to:

  • availability
  • expiry dates
  • capacity limits
  • dress codes
  • responsible service of alcohol rules
  • venue entry policies
  • age restrictions
  • specific redemption instructions
  • change or withdrawal without notice

KIKII does not guarantee that a deal will be available, honoured or suitable for you.

Any dispute about redemption should be resolved directly with the relevant venue, promoter, organiser or partner.

13. Venue entry and safety

KIKII helps you discover nightlife. It does not control venues, door staff, security teams, promoters, event organisers or crowd conditions.

Venues and organisers may refuse entry or service based on their own policies, including:

  • age restrictions
  • ID requirements
  • responsible service of alcohol obligations
  • capacity limits
  • dress codes
  • behaviour
  • ticket validity
  • security concerns
  • licensing rules
  • event terms

You attend venues and events at your own risk.

KIKII is not responsible for:

  • refusal of entry
  • event cancellation
  • venue safety
  • crowd behaviour
  • lost property
  • personal injury
  • property damage
  • transport issues
  • third-party conduct
  • disputes with venues, promoters or organisers

Use common sense, look after your friends, follow venue rules and prioritise your safety.

14. User-generated content

KIKII may allow users to submit, upload, post or share content, including:

  • live updates
  • videos
  • photos
  • comments
  • venue observations
  • event information
  • queue updates
  • crowd updates
  • atmosphere notes
  • profile bios
  • event listings
  • DJ, artist or promoter material
  • venue details
  • reviews or feedback
  • chat messages
  • images, logos, flyers or artwork

You retain ownership of content you submit, but you grant KIKII a worldwide, non-exclusive, royalty-free, transferable and sublicensable licence to use, host, store, reproduce, edit, adapt, publish, display, distribute, promote and make available that content for the purpose of operating, improving, marketing and promoting KIKII.

This licence allows us to:

  • display your content on KIKII
  • resize, crop or format images
  • feature events, venues, artists, DJs or promoters
  • use content in recommendations, search, social previews or marketing
  • share content with service providers as needed to operate KIKII
  • preserve content in backups, logs or archives where required

You are responsible for your content.

By submitting content, you confirm that:

  • you own it or have permission to use it
  • it does not infringe copyright, trade mark, privacy, publicity or other rights
  • it is not false, misleading or deceptive
  • it is not unlawful, defamatory, abusive, hateful, obscene or harmful
  • it complies with these Terms and applicable laws
  • you have obtained any necessary permissions from people shown in the content

15. Live updates

KIKII may allow users to submit live updates about venues or events, including videos, photos, text, queue information, crowd levels, atmosphere or other observations.

To submit live updates, you may need to:

  • have an account
  • be old enough to attend the venue or event
  • allow location verification
  • be physically near the venue or event
  • comply with KIKII’s content rules

Live updates must be genuine, relevant and truthful.

You must not submit live updates that:

  • are fake, misleading or staged in a deceptive way
  • show or encourage illegal drug use
  • show nudity, sexual content or sexually explicit material
  • promote violence, harassment or harmful behaviour
  • invade someone’s privacy
  • include minors without proper permission
  • breach venue rules
  • include confidential or private information
  • are spam, irrelevant or promotional in a misleading way
  • infringe another person’s rights

KIKII may use precise location verification to confirm that you are near the relevant venue or event. Your exact GPS coordinates are not intended to be publicly displayed.

By submitting a live update, you understand that your content, username, profile image, venue name and posting time may be visible to other users.

16. Content moderation

KIKII may review, remove, hide, restrict, edit or disable access to content that we believe breaches these Terms, creates legal risk, harms users or undermines the integrity of the platform.

This may apply to:

  • event listings
  • venue information
  • live updates
  • profile content
  • images
  • videos
  • chat messages
  • comments
  • reviews
  • links
  • promotional material
  • invoice-related misuse
  • any other submitted content

Moderation actions may include:

  • removing content
  • limiting visibility
  • disabling features
  • issuing warnings
  • restricting accounts
  • suspending accounts
  • permanently banning accounts
  • reporting serious matters to authorities where appropriate

We may act based on user reports, internal review, legal notices, platform integrity checks or safety concerns.

We are not required to publish, keep or restore any content.

17. Reporting content and appeals

Users may report content they believe is inappropriate, misleading, unsafe or in breach of these Terms.

Report categories may include:

  • irrelevant or unhelpful content
  • violence, hate speech or harassment
  • spam, scams or fake information
  • illegal activity
  • privacy concerns
  • intellectual property concerns
  • misleading venue or event information
  • other concerns

If your content is removed or your account is restricted, you may contact us and request a review. Include as much relevant context as possible.

Users who repeatedly submit false, malicious or abusive reports may have their own account restricted.

18. Community features

KIKII may allow users to interact through community features such as likes, comments, reactions, follows, live updates, messages, polls, event sharing or other social tools.

You agree to use community features respectfully and lawfully.

You must not use KIKII to:

  • harass, abuse, threaten or intimidate others
  • post hate speech or discriminatory content
  • share sexually explicit content
  • promote violence or self-harm
  • impersonate another person or organisation
  • spam users
  • scam or deceive users
  • share malware or harmful links
  • collect user information without permission
  • promote illegal activity
  • breach someone’s privacy

19. In-app chat

If KIKII offers chat or messaging features, these are provided to help users communicate, coordinate and engage with nightlife-related content.

Chat may allow:

  • text messages
  • image sharing
  • video sharing
  • audio or voice messages
  • event sharing
  • polls
  • reactions
  • links
  • online status or presence indicators

Your profile information, such as username, display name, profile image and online status, may be visible to users you communicate with.

You are solely responsible for what you send through chat.

KIKII does not pre-screen every message before it is sent. We may review reported messages or take action where required for safety, moderation, legal compliance or platform integrity.

You must not send chat content that:

  • is illegal
  • is abusive, threatening or harassing
  • contains hate speech or discrimination
  • is sexually explicit
  • depicts or promotes violence
  • promotes self-harm
  • scams, deceives or phishes users
  • includes spam or unsolicited advertising
  • infringes intellectual property or privacy rights
  • contains malware, viruses or harmful code
  • impersonates another person
  • includes private information you do not have permission to share

Do not share sensitive information through chat, including passwords, banking details, home addresses, identity documents or financial information.

You interact with other users at your own risk. KIKII does not verify the identity, background, intentions or conduct of every user.

20. Chat service providers

KIKII may use third-party providers to operate chat or messaging features.

If we use a provider such as Stream Chat or a similar service, limited information may be shared with that provider to deliver the chat feature, such as:

  • user ID
  • name
  • username
  • email address
  • profile image
  • chat content
  • metadata needed to operate the feature

If you do not want information processed by a chat provider, do not use the chat feature.

Chat features are provided “as is” and “as available”. We do not guarantee that chat will always be secure, uninterrupted, error-free or available.

21. Invoice and billing tools

KIKII may provide invoice, billing or business tools for DJs, artists, performers, contractors or other service providers.

These tools may allow users to:

  • create invoices
  • save client details
  • save venue billing details
  • generate invoice numbers
  • record gig dates, hours, rates and totals
  • manage invoice status
  • download invoices
  • send invoice-related emails
  • remember payment instructions
  • store ABN, ACN or business details

Invoice tools are provided for convenience only. KIKII is not your accountant, tax adviser, lawyer or financial adviser.

You are responsible for:

  • ensuring invoice details are accurate
  • confirming ABN, ACN, GST and tax requirements
  • complying with tax, superannuation and business obligations
  • checking payment terms
  • keeping your own records
  • obtaining professional advice where needed

KIKII does not guarantee that an invoice generated through the platform is legally, financially or tax compliant for your circumstances.

Private invoice details, billing details and saved clients are not intended to appear on your public profile.

22. Uploaded files, images and media

You may be able to upload images, videos, logos, press kits, tech riders, documents, flyers, event artwork or other materials.

You must not upload content that:

  • you do not own or have permission to use
  • infringes copyright, trade marks or other rights
  • contains private information without consent
  • is unlawful, misleading or defamatory
  • contains malware or harmful code
  • breaches these Terms

KIKII may resize, compress, crop, display, store or otherwise process uploaded materials to operate the platform.

23. Third-party embeds and links

KIKII may include links or embeds from third-party services, including:

  • ticketing platforms
  • venue websites
  • Spotify
  • SoundCloud
  • YouTube
  • Google Maps
  • Instagram
  • TikTok
  • Facebook
  • Apple or Google login
  • payment providers
  • external promoter or artist websites

Third-party services are not controlled by KIKII. Their own terms, privacy policies, fees and rules apply.

KIKII is not responsible for third-party content, availability, accuracy, policies, cookies, tracking, payments, refunds, conduct or security.

24. Intellectual property

KIKII owns or licences the platform, including its software, design, branding, layout, interface, databases, text, graphics, logos, features, search systems, recommendation systems and other content.

You must not copy, reproduce, distribute, modify, reverse engineer, scrape, sell, exploit or create derivative works from KIKII without written permission.

Some content on KIKII may be provided by users, venues, promoters, artists, public sources or third parties. KIKII does not claim ownership of third-party trade marks, logos, artist names, venue names, event names or materials.

All third-party rights remain with their respective owners.

26. Privacy and data protection

Your use of KIKII is subject to our Privacy Policy.

Our Privacy Policy explains how we collect, use, store, disclose and protect personal information, including information related to:

  • accounts
  • public profiles
  • venue and event pages
  • invoices
  • location features
  • recommendations
  • live updates
  • chat
  • analytics
  • cookies
  • third-party providers

By using KIKII, you acknowledge that personal information may be handled as described in our Privacy Policy.

27. Cookies and tracking

KIKII may use cookies, SDKs and similar technologies to operate the platform, remember preferences, analyse performance, personalise content, prevent abuse and support marketing where permitted.

You can control cookies through your browser, device settings or available cookie settings.

28. Security measures

To protect KIKII and its users, we may use security tools and controls such as:

  • rate limiting
  • fraud detection
  • bot detection
  • web application firewalls
  • Google reCAPTCHA
  • Firebase App Check
  • SMS verification controls
  • geo-restrictions for high-risk SMS delivery
  • monitoring and logging
  • abuse prevention systems
  • account restrictions

These measures may occasionally block, delay or restrict access to certain features.

29. Prohibited conduct

You must not use KIKII in a way that is unlawful, harmful, abusive or disruptive.

You must not:

  • submit false, misleading or deceptive content
  • create fake venue, event, promoter, artist or DJ information
  • submit fake live updates
  • impersonate another person, venue, promoter, artist, DJ or organisation
  • upload unlawful, defamatory, abusive, hateful or explicit content
  • harass, threaten or abuse other users
  • spam or scam users
  • scrape, crawl, harvest or extract data without permission
  • use bots or automated systems without permission
  • reverse engineer or attempt to copy KIKII’s systems
  • interfere with KIKII’s security or infrastructure
  • attempt to access accounts, systems or data without authorisation
  • upload malware, viruses or harmful code
  • misuse invoice tools for fraud or deceptive conduct
  • use KIKII to promote illegal activity
  • breach venue, event or third-party terms
  • encourage others to breach these Terms

We may suspend or terminate accounts, block access, remove content, report conduct to authorities or take legal action where appropriate.

30. Platform abuse and legal remedies

KIKII takes platform security seriously.

If you attack, exploit, interfere with, reverse engineer, scrape, overload, bypass, disrupt or misuse KIKII, we may take action including:

  • suspending or banning your account
  • blocking your access
  • removing your content
  • restricting features
  • notifying service providers
  • reporting conduct to law enforcement or regulators
  • seeking damages, injunctions, legal costs or other remedies

You agree to reimburse KIKII for losses, damages, costs or expenses caused by your unlawful or prohibited conduct, to the extent permitted by law.

31. App stores and mobile platforms

If you download KIKII from the Apple App Store, Google Play Store or another app marketplace, additional terms from that platform may apply.

You acknowledge that:

  • Apple, Google or the relevant app marketplace is not responsible for KIKII
  • app stores do not provide support for KIKII
  • app stores are not responsible for claims relating to KIKII
  • you must comply with applicable app store terms
  • Apple and Google may be third-party beneficiaries of these Terms where required by their platform rules

32. Disclaimers

KIKII is provided on an “as is” and “as available” basis.

To the maximum extent permitted by law, we do not guarantee that:

  • KIKII will always be available
  • KIKII will be error-free
  • information will always be accurate, complete or current
  • recommendations will suit you
  • venues will be open
  • events will proceed
  • ticket prices will be correct
  • deals will be honoured
  • live updates will be accurate
  • chat features will be uninterrupted
  • third-party links will work
  • user-generated content will be reliable
  • KIKII will be free from viruses, malware or harmful components

You use KIKII at your own risk.

Nothing in these Terms excludes any rights that cannot be excluded under Australian Consumer Law or other applicable laws.

33. Limitation of liability

To the maximum extent permitted by law, KIKII is not liable for:

  • loss of profits
  • loss of revenue
  • loss of opportunity
  • loss of data
  • business interruption
  • reputational damage
  • indirect or consequential loss
  • emotional distress
  • personal injury or property damage caused by third parties
  • venue, promoter, organiser or user conduct
  • third-party ticketing or payment issues
  • unauthorised access caused by third parties
  • inaccurate venue, event, pricing or live update information
  • disputes between users
  • disputes with venues, promoters, artists or organisers

Where liability cannot be excluded, our total liability to you for claims relating to KIKII is limited, to the extent permitted by law, to the greater of:

  • the amount you paid to KIKII in the 12 months before the claim; or
  • AUD $100.

34. Assumption of risk

Nightlife involves real-world environments and third-party venues outside KIKII’s control.

You acknowledge that attending venues, events, parties, clubs, bars, festivals or afterparties discovered through KIKII is at your own risk.

You are responsible for:

  • your own safety
  • your behaviour
  • checking event details
  • complying with venue rules
  • arranging safe transport
  • drinking responsibly
  • assessing whether an event or venue is suitable for you
  • being cautious when meeting or communicating with other users

KIKII does not screen every venue, event, user, promoter, artist, DJ or organiser.

35. Indemnity

You agree to indemnify KIKII, its team, contractors, service providers, affiliates and representatives against claims, losses, liabilities, damages, costs and expenses arising from:

  • your breach of these Terms
  • your content
  • your misuse of KIKII
  • your infringement of third-party rights
  • your unlawful conduct
  • your interactions with other users
  • your attendance at venues or events
  • your use of invoice tools
  • your breach of venue, event, ticketing or third-party terms
  • any fraud, negligence or misconduct by you

This obligation continues after your account ends or you stop using KIKII.

36. Suspension and termination

We may suspend, restrict or terminate your access to KIKII at any time if we believe:

  • you breached these Terms
  • your conduct creates risk for users or KIKII
  • your content is unlawful or harmful
  • you misuse the platform
  • you infringe rights
  • you attempt to interfere with the platform
  • we are required to do so by law
  • continuing to provide access would create legal, commercial or security risk

You may stop using KIKII at any time.

You may request account deletion by contacting us at hello@kikii.com.au.

Some information may be retained where required for legal, security, fraud prevention, accounting, dispute resolution, moderation or backup purposes.

37. Changes to KIKII

We may modify, suspend, discontinue or replace any part of KIKII at any time.

This may include:

  • adding or removing features
  • changing recommendations
  • changing profile tools
  • changing invoice tools
  • changing search or discovery functions
  • removing old content
  • updating venue or event pages
  • changing access rules
  • introducing paid features or subscriptions
  • removing unavailable services

We are not liable for changes, interruptions, suspensions or discontinued features.

38. Changes to these Terms

We may update these Terms from time to time.

If changes are significant, we may take reasonable steps to notify users, such as by publishing an updated version or providing an in-app or website notice.

Your continued use of KIKII after the Terms are updated means you accept the updated Terms.

If a dispute arises, please contact us first so we can try to resolve it informally.

If the issue cannot be resolved informally, the dispute will be handled according to the laws and courts described below.

40. Governing law

These Terms are governed by the laws of New South Wales, Australia.

You agree that the courts of New South Wales, Australia have jurisdiction over disputes relating to these Terms or your use of KIKII.

If you access KIKII from outside Australia, you are responsible for complying with local laws.

41. General terms

Entire agreement

These Terms, together with our Privacy Policy and Cookie Policy, form the agreement between you and KIKII regarding your use of the platform.

Severability

If part of these Terms is found to be invalid or unenforceable, the remaining parts continue to apply.

No waiver

If we do not enforce a right immediately, that does not mean we waive that right.

Assignment

We may assign or transfer our rights and obligations under these Terms. You may not assign your rights or obligations without our written consent.

Force majeure

We are not responsible for delays or failures caused by events beyond our reasonable control, including natural disasters, outages, cyber incidents, strikes, war, terrorism, government action, platform failures or infrastructure issues.

You are responsible for how you use KIKII, what you upload, who you interact with and whether you choose to attend any event or venue.
